Terms of Sales
This accommodation is offered to you by SARL Soleù, and belongs to a private owner.
It is fully equipped, benefits from a private garden, and is available for rental for a weekend, a mid-week or a week.
The price displayed includes accommodation, sheets, towels, and end-of-stay cleaning.
PURPOSE OF THE RENTAL CONTRACT
The parties agree that their respective rights and obligations will be governed by the stipulations of this contract, by the decree of December 28, 1976 as amended and failing that by the provisions of the civil code. The premises covered by this contract are rented furnished on a seasonal basis.
DESIGNATION OF HOUSING
As described in the accommodation sheet.
DURATION OF SEASONAL RENTAL
The Lessor rents the accommodation to the Lessee, on the dates and times as defined in the contract. The Lessee signing this contract concluded for a fixed period may not, under any circumstances, claim any right to remain in the premises.
NUMBER OF PERSONS
The Lessee has indicated that he is taking the accommodation for the number of occupants indicated in the contract.
Any change in the number of people must be the subject of a prior request with the lessor.
Any modification or termination of contract without the lessor being informed will be considered at the initiative of the Lessee.
PRICES AND CHARGES
The rent is fixed for the entire duration of the rental described in the contract.
He understands :
• water, electricity, heating
• end-of-stay cleaning
• the tourist tax paid by the lessor to the Terre de Provence Urban Community
• household linen for all occupants (beds made and towels provided)
TOURIST TAX
The tourist tax is a local tax that the Lessee must pay to the Lessor who then pays it to the Public Treasury.
RESERVATION
To proceed with the reservation of accommodation, the Lessee returns the contract initialed on each page and signed accompanied by the payment of a 30% deposit, online payment or bank transfer.
A copy of the contract must be kept by the Lessor.
The contract concluded between the parties to this deed cannot under any circumstances benefit, even partially, third parties, natural or legal persons, without written agreement from the Lessor.
Any violation of this last paragraph would be likely to result in the immediate termination of the stay at the fault of the Lessee, the price of the stay remaining definitively acquired by the Lessor.
PAYMENT OF THE BALANCE
The balance of the rent amount will be paid by the Lessee no later than 15 days before the arrival date.
BAIL
The Lessee will give the Lessor a deposit of 1000.00 euros as a security deposit intended to cover damage and/or deterioration of the accommodation and furniture caused by the Lessee, as well as loss of keys.
This deposit will be made by bank loan (online reservation) or sent by check on arrival.
In the event that no damage or loss of keys is noted, the security deposit will be returned to the Lessee within a maximum period of 10 days after his departure.
In the event that damage or loss of keys is noted, the security deposit will be returned to the Lessee within a maximum period of 30 days after departure, less the sums covering damage and/or deterioration of the accommodation, furniture and objects. furnishing the accommodation, caused by the Lessee as well as loss of keys or objects. In the event that the house is returned in a proven state of dirt, the sum of €100 will be deducted from the deposit for its cleanliness.
ASSIGNMENT AND SUBLEASE
This rental contract is concluded intuitu personae for the benefit of the sole lessee identified at the top of the contract. Any assignment of this lease, any total or partial subletting, any provision - even free of charge - is strictly prohibited.
OBLIGATIONS OF THE LESSEE
The Lessee will peacefully use the rented accommodation, furniture and equipment according to the destination given to them by the lease and will be responsible for any damage and losses that may occur during the duration of the contract in the premises of which he has exclusive use.
The Lessee will maintain the rented accommodation and return it to a clean condition. Storage spaces marked private will contain the Lessor's private belongings not to be used or moved.
The Lessee will not be able to exercise any recourse against the Lessor in the event of theft or damage to the rented premises.
He will respect the number of people entering the premises, in accordance with his declaration indicated in the paragraph on page 1.
The lessee indicates that he has civil liability insurance including resort guarantee. And undertakes to mobilize it in the event of damage or loss of objects.
THE ARRIVAL
The Lessee must appear on the specified day and time mentioned in this contract.
In the event of late or delayed arrival, the Lessee must notify the Lessor.
THE STATE OF PLACE
An inventory is drawn up jointly and signed by the Lessee and the Lessor or his representative, upon arrival and departure from the gîte. This inventory constitutes the only reference in the event of a dispute concerning the inventory.
The state of cleanliness of the gîte upon the Lessee's arrival must be noted in the inventory. Cleaning of the premises is the responsibility of the Lessee during the stay and before departure. The amount of any cleaning costs is established on the calculation basis mentioned in the contract.
RULES FOR THE POOL
A standard safety system has been put in place for the swimming pool. However, the supervision of the children is entirely the responsibility of the Lessee and they remain his responsibility for the entire duration of the stay.
CANCELLATION standard conditions
Reservations canceled at least 30 days before the start of the stay will receive a 100% refund.
Reservations canceled at least 15 days before the start of the stay will receive a 50% refund. For any cancellation 15 days or less before the start of the stay, no refund will be made.
CANCELLATION BY THE LESSOR
The Lessor reimburses the Lessee in full for the sums paid, as well as compensation at least equal to that which the Lessee would have borne if the cancellation had occurred on that date.
TERMINATION OF FULL RIGHTS
In the event of failure by the Lessee to fulfill one of the contractual obligations, this lease will be terminated automatically.
DISPUTES
Any complaint relating to the inventory of fixtures must be submitted to the Lessor or agent within three days following the start date of the stay.
Any other complaint must be sent to him as soon as possible, by mail.
ELECTION OF DOMICILE
For the execution of these presents, the Lessor and the Lessee elect domicile in their respective domiciles. However, in the event of a dispute, the court of the Lessor's domicile will have sole jurisdiction. This contract and its consequences are subject to French law.
PERSONAL DATA
In accordance with the law of January 6, 1978, you have the right to access and rectify data concerning you.
Soleù undertakes not to transmit the information that you have communicated to it to other companies or organizations, not to use the data to which I can access for purposes other than those provided for by our powers; to only disclose this data to persons duly authorized, by reason of their functions, to receive communication thereof, whether private, public, natural or legal persons; not make any copies of this data unless this is necessary for the performance of my functions; take all measures consistent with custom and the state of the art within the framework of my responsibilities in order to avoid the misuse or fraudulent use of this data; take all precautions consistent with custom and the state of the art to preserve the physical and logical security of this data; ensure, within the limits of my responsibilities, that only secure means of communication will be used to transfer this data; in the event of termination of my functions, fully return the data, computer files and any information support relating to this data.
This confidentiality commitment, in force throughout the duration of my functions, will remain effective, without limitation of duration after the cessation of my functions, whatever the cause, since this commitment concerns the use and communication of personal data.
I have been informed that any violation of this commitment exposes me to disciplinary and criminal sanctions in accordance with the regulations in force, in particular with regard to articles 226-16 to 226-24 of the penal code.
COVID
In the event of Covid measures in the host country or the country of residence of the Lessee, which prohibit travel as provided for in the contract or require quarantine, the Lessee reserves the right to cancel his reservation without cancellation fees. The entire deposit will then be returned to him.
